Civil liability for Japanese Knotweed
Landowners are being urged to put firm plans in place to control Japanese knotweed following a landmark court ruling in Waistell v Network Rail Infrastructure Limited (2017)
CMS Law-Now looks in detail at the issues around Japanese Knotweed - a subject about which a judgment has been expected for some time. The two joined claims determined in this case do not involve significant sums of money but for those owning, managing or insuring significant portfolios of industrial, commercial or infrastructure property then the monetary exposure extrapolated over such portfolios could be significant.
