The government has published in draft a contract that it expects large developers to sign, committing developers to remediate unsafe buildings with which they are associated.
As of 8th July 2022, 48 developers have signed a pledge committing to remediate fire-safety defects in buildings over 11 metres that they have played a role in developing or refurbishing over the last 30 years, in England.
The draft contract turns the commitments in that pledge into a detailed contract. The government is engaging industry, leaseholders and residents and other parties with the aim of finalising the terms of the contract by Wednesday 10th August 2022, so feedback on the contract is needed as soon as possible. The contract will then give effect to the principles agreed in the pledge.
The draft contract can be found below. Managing agents should pay particular attention to section 8, ‘Obligation to engage with Third Parties’, which details how developers will contact and communicate with any person who is not a party to a Contract between a Participant Developer and DLUHC, which includes managing agents.
